With the leaking of a draft decision by the US Supreme Court, we have been given a preview of the future.
It goes much further than overturning Roe v. Wade.
Abortion is the most controversial political/religious/social topic in this country.
Whether you favor or oppose it, it has been codified into law for fifty years.
That is likely coming to end.
Shortly behind it, the Court will make other rulings that will affect this nation for decades to come.
Using the same originalist argument that they are planning to use to prohibit abortion, the conservative majority Court will also dispense with federal laws and leave to state legislatures regarding
· Civil Rights laws, including voting protection, desegregation of schools and businesses, and fair housing laws
· LGBTQ marriage
· Interracial marriage – (Even if Associate Justice Thomas abstains since he is in an interracial marriage, Loving v. Virginia would still be at risk. The question is whether Thomas would abstain, since he refused to do so on a vote that directly involved his wife Ginni, or would he vote. If he voted, it is highly unlikely that he would vote for protecting interracial marriage since that would go against his originalist bent. That means that he would likely vote against federal protection of his own marriage and look to reside in state that would allow his union to be legal.)
· Union and Labor Laws – All protection would revert to employers and corporations, and away from employees and unions
This will continue the dark legacy of the former president, who fomented rebellion and insurrection, gave aid and comfort to our enemies, abandoned our allies, and made three Supreme Court appointments (one which was patently illegal under the same philosophy that prevented President Obama from nominating Merrick Garland).
The above picture of the west entrance to the Court building has an inscription reading:
EQUAL JUSTICE UNDER LAW
With these rulings, the Supreme Court will be running from its responsibility to ensure that this oath rings true.
2022 is not 1952.
Nor should it be.
